Google Sued Over Nexus One Connectivity Issues

Mountain View, California-based Google has been hit with a new class-action lawsuit because of the Nexus One connectivity issue. The complaint, filed by Florida resident Nathan Nabors, claims that Google breached contract by failing to provide good customer support and warn users that Nexus One connectivity would not be as fast or efficient — even in areas with 3G coverage.

Nabors, as usual, is seeking damages on behalf of Nexus One owners in Florida and California. The lawsuit is directly aimed at Google. Taoyuan, Taiwan-based HTC — who manufactured the device — and Bellevue, Washington-based T-Mobile USA — who provides wireless service — are not mentioned in the complaint.

5,000 ‘The Hurt Locker’ Pirates Now Sued

In mid-May, we had noted the fact that the makers of not-so-popular film The Hurt Locker were planning to sue thousands of pirates who partook in downloaded the film illegally. We’re now receiving word that the first 5,000 ‘unidentified’ BitTorrent users have been sued, according to a filing at the United States District Court for the District of Columbia.

Should the court approve the filing, the internet service providers who provided internet connections to the alleged pirates would be mandated to turn over personal information for the recorded IP addresses.

From there, those accused would have two options. Go to court and possibly lose much of what you have, or settle for a couple of thousand of dollars. Either way, the outlook is grim.

HTC Countersues Apple For Five Patent Infringements

HTC LogoIn these litigious times, this next story shouldn’t come as a surprise. In response to a lawsuit Apple filed against HTC not too long ago, the Taiwan company is striking back, counter-suing Apple for the violation of five HTC patents. The company is requesting that the United States International Trade Commission “halt the importation and sale of the iPhone, iPad, and iPod in the United States.”

Of course, we won’t see the United States International Trade Commission making any sort of decision any time soon — but we’ll just add this to the many Apple-related lawsuits we’re following closely.

Sony Gets Sued Over Removal of ‘OtherOS’ Feature from PlayStation 3

At the beginning of this month, Sony released mandatory firmware update 3.21 for the PlayStation 3, which removed the ‘OtherOS’ feature — a not very popular, but still widely used function. Ever since, many users have expressed their dissatisfaction and a few hackers have come up with a way to bring the feature back… kind of. However, PlayStation 3 owner Anthony Ventura, on behalf of other affected PS3 owners, has taken a more radical step by filing a lawsuit in the U.S. District Court for The Northern District of California over the removal of the aforementioned feature.

The filing states:

“This class action seeks to redress Sony Computer Entertainment America Inc.’s (“Sony”) intentional disablement of the valuable functionality originally advertised as available with the Sony PlayStation 3 video game console (the “PS3″). This disablement is not only a breach of the sales contract between Sony and its customers and a breach of the covenant of good faith and fair dealing, but it is also an unfair and deceptive business practice perpetrated on millions of unsuspecting customers.”

The document goes on to cite other allegations against Sony. While the document does not ask for a certain amount of money, it does suggest that compensation for the more than 100 affected users exceeds $5 million.

Kodak Counter-Sued by Apple Over Patent Infringement

Back in January, we learned that Kodak sued Apple along with Research In Motion over allegations that both companies infringed one of its digital imaging patent used to preview images on the devices. In addition, Apple alone was sued twice. The second lawsuit had to do with “certain computer processes.”

Today, court documents revealed that on April 15 Apple officially counter-sued Kodak over allegations that the company also infringes two of its patents related to unified memory architecture and modular digital image processing. Apple filed the lawsuit in the California Northern District Court, and is seeking a trial by jury.

Legal Attacks Continue On The Pirate Bay

thepiratebayWe all knew The Pirate Bay was in rough waters prior to the supposed GGF acquisition (something which may not be happening at all), but now, more legal attacks threaten the site’s very existance (something, no doubt, many are looking for).

This time, the suit comes from legals teams representing both the Italian ‘FIMI’ (Federazione Industria Musicale Italiana) and ‘FPM’ (Federation against Musical Piracy) organizations. The two organizations are aiming their cross-hairs at The Pirate Bay’s top three: Fredrik Neij, Peter Sunde, and Gottfrid Svartholm – seeking upwards of a million Euros in damages in Italy. Their defense? They disposed of and sold The Pirate Bay 3+ years ago.

The Pirate Bay is also threatened by the Dutch government at this time, in which the torrent tracking giant must take its site offline in the Netherlands within the next 10 days or face huge fines.
