Apple And Psystar Finally Reach an Agreement

After a long 17-month legal battle full of controversy, both Apple and Mac clone maker Psystar have finally agreed on a deal. The partial settlement requires Psystar to pay Apple an unspecified amount in damages, and to stop selling Mac clone computers. In return, Apple has acceded to drop all its trademark, trade-dress, and state-law claims against Psystar, which eliminates the need for a trial.

Psystar is not expected to pay Apple until all its appeals have been put to rest. On Monday, when the settlement was filed, Psystar debated that any potential injunction should not include its $50 Rebel EFI utility, which allows users to install Mac OS X on PCs. Psystar stated that Rebel EFI “is composed exclusively of Psystar software, that is not sold in conjunction with any hardware, and that is sold entirely apart from any copy of Mac OS X or any computer running Mac OS X.”

If Apple allows Psystar to sell the Rebel EFI utility, it would be those who buy it that would be violating Apple’s copyright, not Psystar.
